Salem Painting Co makes no guarantees, representations, or warranties regarding:

• The quality, safety, or legality of services provided by contractors
• The accuracy of quotes or estimates provided through our platform
• The availability of contractors to perform requested services
• The timeliness of contractor responses or project completion
• The qualifications, licensing, or insurance status of contractors

All estimates provided through our Site are approximations only and may vary based on actual project conditions, contractor assessment, and other factors. Final pricing is determined solely between the user and the contractor.

Any agreement for services is made directly between the user and the contractor. Salem Painting Co is not a party to any such agreement.

All contractors accessible through Salem Painting Co are independent businesses and are NOT employees, agents, joint venturers, or partners of Salem Painting Co.

Salem Painting Co is not responsible or liable for:

• The quality or outcome of any work performed by contractors
• Any property damage, personal injury, or other harm resulting from contractor services
• Delays, cancellations, or failure to complete projects
• Disputes between users and contractors
• Payment disputes or financial arrangements
• Any actions, omissions, or conduct of contractors

By using our Site and services, you agree to:

• Provide accurate, complete, and current information in all quote requests and communications
• Independently verify contractor credentials, licensing, insurance, and references before entering into any agreement
• Negotiate, review, and execute any service agreements directly with contractors
• Make all payments directly to contractors according to your agreement with them
• Resolve any disputes with contractors directly
• Comply with all applicable laws and regulations

You acknowledge that Salem Painting Co does not screen, verify, or endorse any contractors, and you are solely responsible for evaluating and selecting contractors.

By submitting a quote request through our Site and providing your phone number, you expressly consent to receive SMS text messages from Salem Painting Co and/or our contractor partners related to your inquiry.

These messages may include:

• Confirmation of your quote request
• Follow-up communications regarding your project
• Contractor contact information
• Appointment reminders and updates

Message frequency varies based on your interactions and project needs. Message and data rates may apply depending on your mobile carrier and plan.

To opt out: Reply STOP to any message to unsubscribe from future SMS communications. Reply HELP for assistance. Opting out of SMS will not affect your ability to receive services.

From time to time, Salem Painting Co may offer promotions, discounts, or special offers (such as “$100 off your first project”). Such promotions:

• May be limited-time offers with specific expiration dates

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SALEM PAINTING CO, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any property damage, personal injury, or death resulting from contractor services
• The performance, non-performance, or conduct of any contractor
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Any damages arising from your use of or inability to use our Site or services

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO SALEM PAINTING CO, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Salem Painting Co, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Any dispute between you and a contractor

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to conflicts of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Marion County, Oregon.
